THE MARKETPLACE AGREEMENT

These Terms of Service govern your use of My Savaari, operated by Baron Next Zen. By creating an account or using the app or website, you agree to these Terms and our Privacy Policy.

Important: My Savaari is a technology platform, not a transport company.

We introduce passengers and cargo customers to independent drivers and travel partners. We do not own or operate the vehicle, employ the driver, take possession of goods, or promise that any particular driver, vehicle, trip or delivery will be available. In law we act as an intermediary under Section 2(1)(w) of the Information Technology Act, 2000 and as an aggregator under Section 2(1A) of the Motor Vehicles Act, 1988.

1. Our role

My Savaari supplies software for discovering, requesting, offering and coordinating passenger rides and local cargo. The contract of carriage is made directly between the customer and the driver or travel partner. Baron Next Zen is not the carrier, transport operator, common carrier under the Carriage by Road Act, 2007, courier, warehouseman, insurer or employer for that arrangement, and does not hold a permit under Chapter V of the Motor Vehicles Act, 1988 in respect of it.

Any agency shown in the app is a separate service provider. An agency or driver may have its own licences, insurance, pricing and rules. A profile or document check helps operate the platform; it is not a guarantee of identity, competence, safety, vehicle condition, insurance, availability or lawful conduct.

2. Passenger rides

Passengers may post a ride request, review driver responses, select seats and confirm a driver. A driver may accept, decline or cancel. You must review the route, fare, vehicle and driver information before confirming, follow instructions from the driver during the trip, and use legally required safety equipment.

Passengers are responsible for being at the agreed pickup point, providing accurate information and supervising any traveller they book for. Do not share unnecessary personal or medical information in a request.

3. Drivers and travel partners

Drivers must be at least 18, provide accurate identity and vehicle information, hold the licence, permits, insurance and other documents required by law, and operate only a lawful and roadworthy vehicle. Drivers must not accept work they cannot safely or legally complete. A driver is responsible for their own taxes, employment status, vehicle costs, conduct and compliance with local transport law.

Drivers must not discriminate, harass, threaten, overcharge outside the agreed terms, misuse passenger data, or carry people or goods that are prohibited by law or by these Terms.

4. Local cargo

Goods movement arranged through My Savaari is governed by the Carriage by Road Act, 2007 and the Carriage by Road Rules, 2011, which apply between the sender and the driver as common carrier. My Savaari is not a party to that contract of carriage and does not register as a common carrier under Section 4 of that Act. The sender is responsible for accurately describing, weighing, packing, labelling and handing over the goods. The sender must own or be authorised to send them and must comply with all laws. The driver may inspect, refuse, return or stop a delivery if the goods appear unsafe, unlawful, undeclared, damaged, improperly packed or materially different from the request.

Do not use My Savaari for weapons, explosives, flammable or toxic substances, illegal drugs, stolen property, live animals, human remains, cash, identity documents, dangerous goods, or any item prohibited by law or by a driver’s vehicle capacity. Do not send fragile, perishable, high-value or temperature-sensitive goods unless the customer and driver expressly agree the risk and handling in advance.

5. Own-risk and no-carrier notice

Use of passenger and cargo services is at the user’s own risk. We do not guarantee the safety, timing, route, condition, capacity, security or outcome of any trip or delivery. We are not responsible for accident, injury, death, delay, cancellation, theft, loss, damage, misdelivery, traffic, weather, road conditions, unlawful conduct or disputes between users, except to the extent directly caused by our own proven breach.

What this clause cannot take away

Nothing here limits rights you hold under the Consumer Protection Act, 2019 (including the right to complain about a deficiency in service and to be compensated for it), the Digital Personal Data Protection Act, 2023, Section 79 and the safe-harbour conditions of the Information Technology Act, 2000, the Motor Vehicles Act, 1988 and the Motor Vehicles Aggregators Guidelines, 2020, or any liability for death or personal injury caused by our own negligence. An Indian consumer cannot contract out of these, and this clause does not attempt to.

For goods, My Savaari does not insure, store, package, value, supervise or take custody of the shipment. The sender and driver must resolve delivery terms directly. Consider appropriate insurance for valuable or sensitive goods.

6. Accounts and acceptable use

Keep your account details accurate and your OTP or credentials private. One person must not impersonate another, create accounts to evade restrictions, scrape the service, interfere with the app, upload malware, publish unlawful content, or use another person’s contact or vehicle information without permission. We may restrict, suspend or close access when reasonably necessary for safety, fraud prevention, legal compliance or serious breach.

7. Fares, platform fees and payment

The ride fare or cargo charge is agreed between the customer and driver and is normally paid directly by cash or UPI. My Savaari does not hold or guarantee that journey money. We may charge a platform fee for creating or confirming a connection. The amount and payer are shown in the app before payment; if no fee is shown, none is charged. The platform fee is collected through Cashfree Payments India Private Limited, a payment aggregator authorised by the Reserve Bank of India; their terms also apply to that transaction. We do not store card numbers, UPI PINs or bank credentials. All charges are shown inclusive of applicable Goods and Services Tax.

Driver platform charges may accumulate as dues. A driver with overdue dues may be prevented from accepting new work until the balance is resolved. See the Refund & Cancellation Policy for fee refunds and payment failures.

8. Ratings, content and communications

You are responsible for reviews, notes and information you submit. Do not post personal data, threats, hate, sexual content, false accusations or unlawful material. You give Baron Next Zen permission to use submitted content to operate, moderate and improve the service, while retaining your rights in content you own. Calls or messages arranged between users may be governed by their own phone provider and privacy settings.

9. Intellectual property

My Savaari, its branding, software, design and content belong to Baron Next Zen or its licensors. We grant you a limited, non-transferable, revocable permission to use the app for its intended purpose. You must not copy, reverse engineer, resell or misuse the platform.

10. Changes, suspension and termination

We may change features, fees, these Terms or the availability of a service. The updated version will be posted with a new date. You may stop using the service or request account deletion at any time. Rights and obligations relating to payments, safety, disputes, confidentiality, liability and records may continue after termination.

11. Grievance redressal, governing law and contact

Complaints of any kind — service, content, payment, driver conduct or personal data — go first to our Grievance Officer, who is named in the Privacy Policy. We acknowledge within 24 hours and resolve within 15 days, as required by Rule 3(2) of the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 and Rule 4(5) of the Consumer Protection (E-Commerce) Rules, 2020.

These Terms are governed by the laws of India. Courts at Namakkal, Tamil Nadu have jurisdiction — except that, under Section 34(2)(d) of the Consumer Protection Act, 2019, a consumer may always file a complaint before the District, State or National Commission where they reside or work, and nothing in these Terms restricts that right.
